อีกแล้ว! ITC สั่งแบนมือถือเก่าซัมซุงหลายรุ่น หลังตัดสินว่าละเมิดสิทธิบัตรแอปเปิล

เช่นเดียวกับกรณีที่แอปเปิลโดนมาก่อนหน้านี้ ล่าสุด ITC ได้ตัดสินแล้วว่ามือถือของซัมซุงบางรุ่น ได้ละเมิดสิทธิบัตรของแอปเปิล พร้อมกับออกคำสั่งแบนสินค้าเหล่านี้จากการนำเข้ามาจำหน่ายในเขตแดนของสหรัฐอเมริกา

สิทธิบัตรที่ ITC เห็นว่าซัมซุงได้ละเมิดแอปเปิลในครั้งนี้ คือสิทธิบัตรที่เกี่ยวข้องกับหน้าจอสัมผัส ที่หลายคนเรียกว่า "สิทธิบัตรสตีฟ จ็อบส์" ส่วนอีกฉบับมีเนื้อหาเกี่ยวกับการตรวจสอบเมื่อมีการเสียบอุปกรณ์อื่นเข้ามาในตัวเครื่อง

คำสั่งแบน จะมีผลภายใน 60 วัน โดยภายในระยะ 60 วันนี้ รัฐบาลของสหรัฐ มีสิทธิที่จะออกคำสั่งยับยั้งไม่ให้มีการแบนได้ เช่นเดียวกับกรณีที่เพิ่งเกิดขึ้นกับแอปเปิลไม่กี่วันที่ผ่านมา

สิทธิบัตรที่ ITC ตัดสินว่าซัมซุงละเมิดแอปเปิล ไม่ใช่สิทธิบัตรที่กลายเป็นมาตรฐานอุตสาหกรรม หรือ SEP (standard-essential patent) เพราะฉะนั้นคำสั่งยับยั้งการแบนของรัฐบาลสหรัฐจากกรณีที่แล้ว อาจจะไม่ใช่ตัวชี้วัดที่ดีว่า ซัมซุง จะรอดจากคำสั่งแบนในครั้งนี้
