ผมเห็นข่าวนี้ ไม่รู้ว่าฟ้องกันเรื่องนี้หรือเปล่า

สงสัยใครขยับฟ้องก่อน มีสิทธิ์แพ้ เลยรีรออยู่

กลัวโดนสวนด้วย ลูกใหญ่ จากสิทธิบัตร Nortel เดี๋ยวจะตายเองซะก่อนมั้งเลยรีรออยู่

+1 ปล่อยให้ผู้ผลิตฮาร์ดแวร์ต้องเผชิญชะตากรรมทั้งๆ ที่ต้นเหตุมาจากแอนดรอยด์

เจอตัวคนแย่งชื่อ id ไปแล้ว :p

ไม่ใช่ดันครับ แต่เป็นทุนพัฒนาต่างหาก :P

อืม ประมาณว่า ..อยากได้ส่วนลดใช่ไหม มาสนับสนุบ Windows Phone ของเราสิ

สำหรับรายเล็กที่ไม่ได้มีส่วนแบ่งในตลาดมากนัก (หรือน้อยมาก) การลงทุนฟ้องจะไม่คุ้มค่าครับ

จะเห็นได้ว่า การฟ้องร้อง มักเกิดกับกรณีที่ ผู้ผลิต นั้นๆ เข้ามามีส่วนแบ่งในตลาดมากขึ้นเรื่อยๆ หรือ มากขึ้น และ อาจจะทำให้ส่วนแบ่งผลิตภัณฑ์ในตลาดของ เจ้าของสิทธิบัตร ลดลง จนกระทำต่อยอดขายหรือกำไรมากขึ้น

ซึ่ง การฟ้องร้องที่เกิดขึ้นจากบริษัทใหญ่ ส่วนมาก เกี่ยวข้องกับ ผลกระทบการตลาด ยอดขาย กำไร ของผู้ถือสิทธิบัตร หรือ หากฟ้องร้องแล้ว มีโอกาสที่ได้รับผลตอบแทนมาก หรือ สูง

ผมจำไม่ได้เหมือนกันเกี่ยวกับ สิทธิบัตร หรือ ลิขสิทธิ์ ที่มีการละเมิดกัน แต่โดยทั่วๆ ไปแล้ว ...

การฟ้องร้องไปที่ผู้ผลิต อุปกรณ์ที่ใช้ Android เป็นระบบปฏิบัติการ น่าจะได้ผลตอบแทนที่คุ้มค่ามากกว่า ครับ ...

การฟ้องร้อง Google อาจจะไม่ได้ผลตอบแทนที่มากมายเท่ากับฟ้องผู้ผลิต ผลิตภัณฑ์ ที่ขายในตลาด ครับ ...

จริงๆ ... ตัว Google เอง น่าจะทำอะไรบ้าง เพื่อแก้ปัญหาเรื่องนี้ ไม่เช่นนั้น ต่อๆ ไป หาก การถูกฟ้องร้องต่อผู้ผลิตอุปกรณ์ Android มากขึ้นเรื่อยๆ จนทำให้ต้นทุนสูงมากขึ้น หรือ ราคาขายของอุปกรณ์ Android สูงขึ้นไปด้วย ผู้ผลิต คงจะเปลี่ยนการเลือกใช้จาก Android ไปใช้ระบบปฏิบัติการอื่นๆ แทน ... ครับ

MS มีสิทธ์บัตรในมือเยอะครับ MS อ้างว่ามีสิทธ์บัตรในมือมากพอที่จะฟ้องใด้ แต่ถ้าจ่าย MS จะไม่ฟ้อง สิทธ์บัตรที่ว่าไม่เคยมีการเปิดเผย ... แต่ถ้า MS ไม่มีสิทธ์บัตรคนอื่นที่ละเมิดจริง MS ก็จะโดนเรื่อง Patent misuse ที่หลังเอง

อย่างไรก็ตามหากผู้ผลิต hardware ต้องชื้อ windows และต้องการใด้ windows ตัวถัดไปล่วงหน้า การยอม MS อาจเป็นทางเลือกที่จำยอม

Microsoft filed an action today in the International Trade Commission and in the U.S. District Court for the Western District of Washington against Motorola, Inc. for infringement of nine Microsoft patents by Motorola's Android-based smartphones. The patents at issue relate to a range of functionality embodied in Motorola's Android smartphone devices that are essential to the smartphone user experience, including synchronizing email, calendars and contacts, scheduling meetings, and notifying applications of changes in signal strength and battery power.
We have a responsibility to our customers, partners, and shareholders to safeguard the billions of dollars we invest each year in bringing innovative software products and services to market. Motorola needs to stop its infringement of our patented inventions in its Android smartphones.

Android infringes on patents from Oracle, Apple, Microsoft, and Skyhook. I'm surprised the article doesn't mention this to remind people who the real culprit is...Im sorry, but Google completely screwed up big time and the hardware manufacturers have to pay for this. the manufacturers knew the risks of going with an OS that has no support program in place (that's what comes with no licensing fee)

Microsoft did not want to sue motorola, it was a last resort. they were in patent licensing discussions.....I'd like to remind everyone that HTC pays a licensing fee to microsoft because android infringes on microsoft patents (meaning HTC agrees with microsoft that android infringes on MS patents)..... when this deal happened, microsoft stated they are talking to to the others

ไหนจะเรื่องการละเมิดลิขสิทธ์ OS และ Support Driver บน OS อีก

ไม่มี OS นักพัฒนาโปรแกรมก็ขรี้แตกสิครับ
